Public Comments on Revisions to the Compensation Guidelines Respecting Damages Relating to Offshore Petroleum Activity

The Canada-Nova Scotia Offshore Petroleum Board (CNSOPB) and the Canada-Newfoundland and Labrador Offshore Petroleum Board (C-NLOPB) jointly revised the Compensation Guidelines Respecting Damages Relating to Offshore Petroleum Activity (previously released in September 1991 and March 2002). 

With the February 2016 amendments to the Accord Acts and the addition of the new Financial Requirements Regulations to both the federal and provincial Accord Acts, a decision to update the Compensation Guidelines was made. 

The Compensation Guidelines are intended to provide claimants and operators with information and guidance related to the losses and damages resulting from offshore petroleum related work or activities in the Nova Scotia and Newfoundland and Labrador Offshore Areas to achieve compliance with the Accord Acts and Regulations. It also provides plain language definitions and explanations as to how the Boards interpret the Accord Act and Regulations and the process for seeking compensation.

The two Boards are currently seeking comments on the draft Compensation Guidelines Respecting Damages Relating to Offshore Petroleum Activity. Comments may be submitted to the addresses below or emailed to consultation@cnsopb.ns.ca until June 2nd, 2017. Upon receipt, all submissions will be considered by the two Boards.
